Fair practice applied on the film set

Objective:

Develop practical tools aimed at improving working conditions and working conditions in audiovisual and film production.

Type of activity:

About 18 representatives of producers, makers and facilitating professionals will engage in a year-long dialogue and develop practical tools together to translate the Fair Practice Code into practice. The Film Fund is acting as a partner in and co-financier of this process.

The chain involved in this sub-sector is long and complex. Many disciplines are present on the film set, both artistic and supportive. In addition, professional groups are at work prior to production and after. Around this production chain also move the large (foreign) streamers, broadcasters and exhibitors/operators with large financial interests and thus influence the price of labor in the production chain. After the Fair Practice Code was launched some time back, this sector showed initiative by drafting a declaration of intent in which the code was translated to film sets. With the chain table process, the next step is taken toward making the principles for appropriate working conditions and terms more concrete. Doreen Boonekamp, sector expert and independent consultant, stepped in as independent chair of the chain table.

Framework of terms and job building as the final product

With much appreciated help from the Dutch Academy for Film (DAFF), we succeeded in convening a kick-off meeting on June 7, 2022 with about 30 representatives from the corporate sector. This group proved driven to start a journey towards a more concrete translation of the Fair Practice Code to the workplace. Again with help from DAFF, composition for the chain table was made. Primarily it is about workers and employees. Those involved who do not take a seat at the chain table will remain connected by sitting on an experience panel. There will also be two sounding board groups of stakeholders such as financiers, educational and scientific institutions. Goals are the creation of a framework of terms including definitions and a job structure including classifications and hourly or daily rates based on these. At the Netherlands Film Festival (NFF) on September 23, 2022, members of the chain table were guests for a presentation of this initiative.

Delineation of sub-sector

Led by Doreen Boonekamp, all 18 intended representatives met on September 15, 2022. In a constructive discussion, the approach was established, including frameworks for discussion topics and goals. It was agreed that initially the chain table would be limited to the production chain, possibly the exploitation of film and audiovisual productions could be added later. Interests of both self-employed and employees will be discussed, but the focus will be on the first group. To arrive at practical instruments, the chain table is focusing on developing a framework of concepts, a model for reference functions and then a corresponding fee guideline. Where necessary, the chain table will make use of external legal advice and independent research by the Berenschot agency.

The Film Fund acts as a partner in and co-financier of this track.

The launch file covers the process of starting the chain table. It also provides insight into relevant studies, regulations, developments, parties, terms and conditions of employment and working conditions within the subsector.

The goals memo includes the intended goals of the chain table regarding practice tools, support and communication, implementation and assurance, and enforcement.

The practical tools to be created by the chain table could include good examples, framework of terms (with definitions), manual, fee guideline, proposals for (collective) agreements.
