The proposals are aimed at clients and contractors involved in producing audiovisual productions in the form of feature films, short films, documentaries, animation, series, and innovative media productions. Feedback by fairPACCT and the chain table based on the responses received will take place in mid-December (this has since been moved to early 2024).<\/strong> <strong>The four proposals from the chain table are a prerequisite for the next phase of translation into practical guides for application in the field.<\/strong><\/p>\n<p><\/p>\n<h3><strong>AV Sector Framework of Definitions<\/strong><\/h3>\n<p>The Film\/AV production chain table is a broad-based platform. It includes representatives from the entire field: from producing broadcasters, producers, screenwriters, and directors to all creative and technical professionals who are part of the cast &amp; crew. Audiovisual productions in the form of feature films, short films, documentaries, animation, series, and innovative media productions are financed purely on a project basis. Almost all workers operate as freelancers. There are (as yet) no (collective) agreements regarding terms and conditions on which clients and contractors can rely. In September 2022, the chain table therefore began drafting a Framework of Definitions for the audiovisual sector. The goal is to <strong>provide commonly used terms in contract negotiations with a neutral definition<\/strong>. In this way, clients and contractors are talking about the same thing when they use these terms during negotiations. This prevents misunderstandings and saves time; negotiation time can then be used to further define these terms. The Framework of Definitions includes 300 general and legal terms with definitions and has been verified by De Koning Vergouwen Advocaten.         <\/p>\n<p><strong>For consultation:<\/strong><\/p>\n<p><a href=\"https:\/\/development.burobits.nl\/wp-content\/uploads\/2023\/11\/Begrippenkader-AV-sector-versie_1.0-20231103.pdf\" target=\"_blank\" rel=\"noopener\">FairPACCT Chain Table, Fair pay proposal 1: &#8216;AV sector Framework of Definitions_ version 1.0-20231103<\/a><\/p>\n<h3><strong>Guideline for Safe and Healthy Working in the AV sector<\/strong><\/h3>\n<p>The second tool from the Film\/AV production chain table concerns a Guideline for Safe and Healthy Working in the Audiovisual sector. This Guideline includes <strong>principles intended to safeguard the physical and psychosocial safety of contractors involved in making professional audiovisual productions<\/strong>. The principles will be translated into a safety policy and plan, which will be tailored to the specific characteristics of a production and applied through mutual working agreements. The principles only apply to those days or day parts during which work must be performed at a specific time and location to execute the assignment, and for which coordination and planning by the client are required. The Film\/AV production chain table assumes that the principles will have a normative effect and become part of the negotiation process. These establish a foundation for reaching clear agreements when entering into a contract where such a foundation is currently lacking. The emphasis in Guideline version 1.0 is on the shooting period of an audiovisual production and its preparation and completion. A new version of the Guideline will examine whether additional principles can be added for different types of productions and other phases in the creation of an audiovisual production.       <\/p>\n<p><strong>For consultation:<\/strong><\/p>\n<p><a href=\"https:\/\/development.burobits.nl\/wp-content\/uploads\/2023\/11\/Leidraad-Veilig-en-Gezond-werken-AV-sector_versie-1.0-20231103.pdf\" target=\"_blank\" rel=\"noopener\">FairPACCT Chain Table, Fair pay proposal 2: &#8216;Guideline for Safe and Healthy Working in the AV sector_version 1.0-20231103<\/a><\/p>\n<h3><strong>AV Sector Assignment Compass<\/strong><\/h3>\n<p>The third tool is an Assignment Compass. <strong>This technical instrument was developed by Bureau Berenschot in collaboration with the chain table to establish minimum hourly rates, or starting rates, for freelancers<\/strong>. Using the Assignment Compass as a guide, you can categorize the combination of tasks and activities of an assignment per audiovisual production. As a first step, the chain table mapped out and briefly described the various roles (approximately 200) in the development, pre-production, production, and post-production phases. These were then grouped into professional fields. Within 13 professional fields, Bureau Berenschot conducted at least two interviews with contractors with different task packages. For these <em>reference assignments<\/em>, Bureau Berenschot wrote specific standard texts and categorized them at the corresponding level (bands A to K) in the Assignment Compass. Subsequently, a number of <em>derived<\/em> <em>descriptions<\/em> of tasks and activities were drafted and categorized within each professional field. The <em>reference assignments<\/em> (green boxes) and <em>derived descriptions<\/em> (blue boxes) are intended as benchmarks. By looking at these and the level indicators, you can also categorize other assignments.        <\/p>\n<p>Note: The Assignment Compass is currently formatted in Excel but will be converted into a digital module in a subsequent phase. <\/p>\n<p><strong>For consultation:<\/strong><\/p>\n<p><a href=\"http:\/\/fairpacct.nl\/wp-content\/uploads\/2023\/11\/Kopie-van-Opdracht-Kompas-AV-sector_versie-1.0-20231103.xlsx\">FairPACCT Chain Table, Fair pay proposal 3: &#8216;AV sector Assignment Compass_version 1.0-20231103<\/a><\/p>\n<h3><strong>AV Sector Starting Rates Guideline<\/strong><\/h3>\n<p>With the Assignment Compass as a classification tool, Bureau Berenschot has developed a fourth tool with input from the chain table. This concerns <strong>the recommendation &#8216;From Wage to Freelance Starting Rate&#8217; with a proposal for minimum hourly rates (starting rates)<\/strong> applicable to a beginner in each of the 11 levels (bands A to K) in the Assignment Compass. In view of the wishes of the Council for Culture and State Secretary Gunay Uslu of the Ministry of Education, Culture and Science, a comparison was made with incomes in adjacent sectors. In this case, these are the collective labor agreement (CAO) for Broadcasting Personnel and the CAO for Theater and Dance. The averages of these were taken. The results were tested against the so-called &#8216;BV Nederland&#8217; (Dutch corporate standards). The starting rates roughly consist of two parts: a basic hourly rate and a freelance surcharge percentage. The starting rates (reference date July 2023) are based on 1,686 net deployable hours (i.e., excluding holidays and weekday leave) and approximately 1,350 billable hours per year. Bureau Berenschot recommends aligning the indexation of the basic hourly rate (annually) with the average level of indexation of the adjacent CAOs. In the next phase, the application of the starting rates will be further translated into practical guides.         <\/p>\n<p><strong>For consultation:<\/strong><\/p>\n<p><a href=\"http:\/\/fairpacct.nl\/wp-content\/uploads\/2023\/11\/Van-loon-naar-ZZP-starttarief_v4.3.1-20231018.pdf\">FairPACCT Chain Table, Fair pay proposal 4: &#8216;From Wage to Freelance Starting Rate_v4.3.1-20231018<\/a><\/p>\n<h3><strong>Specific practical guides for application necessary<\/strong><\/h3>\n<p>The chain table supports the four tools currently presented. However, it wishes to explicitly state immediately that these do not tell the entire financial story. <strong>After the delivery of these four prerequisite tools for fair practice and fair pay, the chain table will therefore begin the translation for their application in practice<\/strong>. For how do you use a starting rate and a Reference Assignment in the Assignment Compass to arrive at the valuation of a specific assignment in one of the departments of an audiovisual production? After all, the audiovisual sector often works with a daily rate that includes preparation and completion time, or with a lump sum fee for an entire assignment or an amount for a script version. Aspects such as cancellation or the period during which a contractor must remain available also play a role, as does the use of one&#8217;s own equipment. Furthermore, the level of compensation for &#8220;flexicurity&#8221; must be mapped out. A consultancy firm will be involved to collect (detailed) information through a compact survey among all constituencies of the professional associations. In light of all this, the chain table will produce specific manuals per cluster of professional fields before the summer of 2024. Ultimately, the four tools already developed and the practical guides will be published on a central platform, and agreements will be made regarding a point of contact, monitoring, and evaluation.        <\/p>\n<h3><strong>Financial position of stakeholders <\/strong><\/h3>\n<p>Audiovisual productions in the form of feature films, short films, documentaries, animation, series, and innovative media productions are financed on a project basis in the various phases of creation. This differs fundamentally from other cultural subsectors where it mainly concerns the support of individual artists&#8217; work or (multi-year) support for institutions. Freelancers and companies in the film production sector work together in ever-changing configurations on a specific production. This involves freelancers such as directors, screenwriters, crew, and cast, as well as companies of producers, animation studios, post-production companies, and suppliers. For each production, a producer brings together specific financing through public and private parties such as funds, distributors, sales agents, broadcasters, streaming services, investors, and co-producers. Due to the project-based method of financing and the frameworks set therein, there is little room to build up financial resilience.     <\/p>\n<p>From 2025, the national government has \u20ac34.1 million structurally available for fair pay in the cultural and creative sector. In view of this, a national study commissioned by Kunsten &#8217;92 is currently underway into the additional fair pay costs at organizations that receive multi-year subsidies from the State and the national cultural funds. This also provides an indication of the additional costs in subsectors that are subsidized on a project basis, such as the film sector. <strong>Using the fair pay chain table tools and further data from the Netherlands Film Fund, the additional costs for audiovisual productions will be calculated even more precisely in a follow-up study in early 2024<\/strong>, partly based on a number of cases. They observed that the earning capacity of workers in the cultural and creative sector is lagging behind. The councils called for the development of guidelines for reasonable compensation. Based on this, a Labor Market Agenda appeared in 2017 with three priorities: structural social dialogue, strengthening earning capacity, and improving working conditions. The Fair Practice Code also emerged with three principles: fair pay, fair share, fair chain.     <\/p>\n<h3><strong>Specific preliminary research<\/strong><\/h3>\n<p>Film\/AV is one of the five cultural subsectors where the financial situation is most concerning and for which the Ministry of Education, Culture and Science considered a concrete implementation of the fair pay principle to be necessary in any case. HTH Research therefore presented the report &#8216;Better Terms of Employment and Working Conditions in the Cultural and Creative Sector. A proposal for follow-up steps 2021-2024&#8217; in March 2021, commissioned by Platform ACCT. In summary, this proposal is as follows:  <\/p>\n<ol>\n<li>Research<br>A study (interviews, survey) among the various groups of workers regarding earning capacity, terms of employment, and working conditions, specifically including the need for and potential implementation of a (rates) guideline.<\/li>\n<li>Awareness<br>&#8211; 2.1. Making information about the financial side of the film sector transparent and sharing it. For example: mapping the actual costs (and hours spent) of several productions and sharing this sector-wide. Or: organizing sessions on topics such as terms of employment. Following the example of the NFF extended sessions on recoupment (in 2019).    <br>&#8211; 2.2. Ensuring the work processes of screenwriters, financiers, and producers align better\/more frequently. More experimentation can be done with, for example, a showrunner, involving production in scriptwriting, and involving screenwriters in drafting budgets. <\/li>\n<li>Development\/Dialogue<br>&#8211; 3.1. Creating a framework of definitions: what agreements should you make as a worker, and what do the terms used in the sector mean? Sharing the framework of definitions with sector parties to create a shared framework.  <br>&#8211; 3.2. Based on conducted research and feedback on the framework of definitions, a choice can be made to establish hourly or daily rates (minima per type of production) for film crew members.<\/li>\n<\/ol>\n<h3><strong>fairPACCT program and composition of the Film\/AV production chain table <br><\/strong><\/h3>\n<p>The three-year fairPACCT program of Platform ACCT began in 2022 with the help of a subsidy from the Ministry of Education, Culture and Science to concretize fair pay. The Film\/AV production Chain Table started in September 2022. It currently consists of 20 members, some of whom represent multiple professional associations: fourteen representatives of workers (Kunstenbond, FNV Media &amp; Cultuur, Fijn Weekend, DDG, Auteursbond, Netwerk Scenarioschrijvers, DPA, NCE, NSC, VCA, ACM, PNN, ACT, and NAA) and six representatives of employers\/clients (NAPA, NCP, NPO, and CvO). Doreen Boonekamp, director and independent advisor in the cultural and creative sector, is the independent chair.   <\/p>\n<h3><strong>Chain table goals memorandum October 2022<\/strong><\/h3>\n<p>In October 2022, the chain table adopted a goals memorandum. It focuses on everyone involved in cultural productions in Film\/AV in the form of feature films, short films, documentaries, animation, series, and innovative media productions. Since workers involved in these productions are almost exclusively freelancers, the Chain Table concentrates on the contractor-client relationship. Short-term goals identified include: drafting a framework of definitions and formulating categories of roles with descriptions per role. Furthermore, in view of the framework of definitions and the distinct job descriptions, making proposals regarding the valuation\/remuneration of roles and regarding amounts for, for example, hourly, daily, and\/or lump-sum rates, while taking potential negative side effects into account. These goals were elaborated in November 2023 in the form of four fair pay proposals. In the meantime, the proposals have also been discussed with sounding board groups of experts and financiers. In the first half of 2024, the proposals will be further refined through practical guides per cluster.
